The owner of real estate has the right to dispose of his property at his own discretion. This also applies to the definition of persons living in his living space. The owner can, by a court decision, evict the specified person from his living space and remove him from the registration register.

Step 1
Choose a lawyer to represent your case in court. Determine the requirements of the claim. You can simply remove a certain person from registration, or completely evict him from the living space. Consult a lawyer or attorney on this matter.
Step 2
With the help of a lawyer, write a statement of claim to the court. Reflect all basic requirements in the claim. Discuss all possible points and nuances of your case with a lawyer or attorney. Justify clearly all the requirements presented in the claim for deprivation of registration of a specific person. Collect written evidence if possible. Indicate their list at the end of the application, and attach copies of documents certified by a notary to the claim. Enlist the testimony of witnesses, attach the testimony to the lawsuit. Provide copies of title deeds for real estate, certified by a notary.
Step 3
File a claim with the federal court where the property is located. Pay the state fee. After consideration of your application, the date and time of the trial will be determined, and a judge will be appointed. Leave the conversation to your lawyer at trial. When the judge addresses you, answer the questions only to the point of the matter and clearly. After the court announces a positive decision on your statement of claim and issues a resolution to “deregister”, wait a ten-day period. According to the legislation, during this time the decision made by the court will come into force. If your claim was denied, then within ten days you can file a cassation appeal.
Step 4
Collect the decision ten days later at the court office. Take the decision to the passport and visa office in your area. On the basis of it, in accordance with article 7 of the law of the Russian Federation No. 5242-1, the specified person will be immediately and without delay removed from the registration register.
