Dismissal from military service can occur due to various circumstances. It is on these circumstances that the possibility and procedure for the restoration of a former soldier to service depends. In cases when it comes to unjustified or illegal dismissal, as well as dismissal carried out in violation of the provisions of the Federal Law "On conscription and military service", reinstatement is carried out in court.

Step 2

In such circumstances of dismissal, file a claim for reinstatement with the local judicial authorities, attaching to the claim the justification of the illegality or unreasonableness of the dismissal. On the basis of a court decision, the order of dismissal is canceled, the citizen is reinstated for military service with mandatory compensation for losses incurred for the entire period of non-fulfillment of duties.

Step 3

In the event that there was a dismissal at your personal request, or in connection with a reduction in staff, reinstatement is not made. At the same time, the law and practice of admission to military service allows the possibility of concluding a new contract, provided that the age limit for military service has not been reached at the time of dismissal.

Finally, the third probable reason for dismissal is the violation by the serviceman himself of the terms of the contract, on the basis of which the dismissal was carried out. Usually, in such cases, we are talking about a violation of the service regime, non-observance of the rules of the internal order, and the reason may also be a committed crime, an outstanding conviction, etc. This is exactly the case when the path to recovery is closed, since returning to service will require a new contract, and personnel services rarely agree to conclude it with a soldier who was dismissed under such negative circumstances.
