Maternity capital is a state program to stimulate the birth rate in the Russian Federation. However, it should be borne in mind that it is not unlimited, but has a well-defined expiration date.
Maternity capital is a lump sum payment that mothers have the right to receive for the birth or adoption of a second child, or fathers who are single-handedly raising two or more children. In this case, the receipt of maternity capital is carried out only once. If these funds were not received at the birth or adoption of the second child, they can be received when the next one appears.
Maternal capital
Despite the fact that formally maternity capital is calculated in monetary terms, the state sets certain restrictions on the disposal of these funds. These restrictions, as well as other characteristics associated with the procedure for using maternity capital, are fixed in Federal Law No. 256-FZ of December 29, 2006 "On additional measures of state support for families with children."
In particular, paragraph 3 of Article 7 of the specified regulatory legal act establishes that the owner of maternity capital can be directed to three variants of the goal. The first of them is the improvement of living conditions, that is, the acquisition of an apartment, room, house or other housing. The second goal for which maternity capital can be directed is the education of children, and this money can be spent on educating not only the second child, as a result of whose birth the maternity capital was received, but also other children. Finally, a third possible goal is to channel these funds towards the mother's future pension.
Initially, the established amount of maternity capital was 250 thousand rubles. However, paragraph 2 of Article 6 of the law on maternity capital determines that it is subject to annual indexation, and therefore in 2014 its value has already reached 429,408 rubles.
Program duration
When planning how to dispose of maternity capital funds, it should be borne in mind that the current law "On additional measures of state support for families with children" provides for a deadline for this program. Thus, Article 13 of this regulatory legal act establishes that maternity capital can be received by families in which the second or subsequent child was born or was adopted before December 31, 2016.
Thus, the current version of the law provides that the birth or adoption of children later than this date will not entail the right to receive maternity capital. At the same time, however, it will be possible to dispose of these funds after its occurrence.
