Hazing is called an unofficially established hierarchical system among the military personnel of the armed forces of any state. Hazing is based on rank value, in the army - in fact, on a certain period of service of each soldier.
Discriminatory feature
Hazing is a form of discrimination that usually manifests itself in the form of exploitation or even violence against a person, hazing relationships of this kind are semi-criminal in nature.
It is believed that practically all collectives of soldiers are subject to hazing to varying degrees; cases of its manifestation are found even in the units of elite troops. The reasons for the appearance can be varied, and no general trend has been identified, opinions on this matter are also completely different. Factors can be racial differences, religious, but the main one is always the length of service.
Hazing refers to an anti-statutory relationship that is punishable by the Criminal Code of the Russian Federation. Relationships between servicemen that are not described in the combined-arms regulations are called non-statutory. Hazing is considered to be violations of statutory relations between persons of different terms of conscription.
Qualifying bullying as an offense
For a long time, enough information about this phenomenon has accumulated and criminal law has introduced differences in crimes within the framework of the concept of hazing. This offense has two subjective types: when the intent is aimed at self-affirmation, maintaining their status and exploitation of the younger soldier by the older servicemen, and personal intent, due to personal hostility.
The main negative manifestation of bullying is that it undermines the authority of the army as a whole; more and more young people are trying to evade service due to the existence of bullying. Hazing can manifest itself in various forms of severity, disciplinary offenses are not criminally punishable, while there are such manifestations that fall under the Criminal Code of the Russian Federation, responsibility for them will go precisely in a criminal procedure. Any other actions that are not considered criminally punishable should be considered a disciplinary offense, and responsibility for them is already provided for under the current charter of the armed forces.
Now, most cases of bullying are aimed at using the labor of young employees and are aimed at the personal benefit of the command staff. Since the 60s, such hazing has existed in the army, first in the Soviet, and then in the Russian, as a way of managing non-statutory economic activities.
