Small domestic clashes often turn into serious physical injuries, but it can be problematic to prove them in court. That is why court hearings turn into endless soap operas, tiresome for the judge and fraught with a new round of scandals for the plaintiff, defendant and witnesses. And all because the victims ignore elementary rules.
Instructions
Step 1
Get a medical clearance. If the beatings are serious and fraught with internal bleeding, then you should call an ambulance. If the victim is able to move independently, then his route is to the nearest emergency room. A medical report is 95 percent of success. Beatings and tortures, which do not leave marks on the body, fall into five percent. But, as a rule, the aggressor has special knowledge and skills in this area, which can be mentioned in the statement, if possible, backing up his words with facts. This will be considered at the stage of checking the application with the police.
Step 2
In the first hours after the beating, the victim is in a state of shock, she is not able to think coherently and analyze the situation. A person wants to move aimlessly, dumping adrenaline, or, conversely, to be in shelter, under the supervision of loved ones. In fact, the best helpers in the first hours after the beating are witnesses. It would be good to remember who could have witnessed the incident: street vendor, courier, driver, neighbors. In some cases, the witness may even be a taxi driver who will take the victim to the emergency room. The more witnesses saw the incident, the easier it is to prove in court the fact of beating and to establish the identity of the offender.
Step 3
Having enlisted the support of witnesses and medical certificates, the victim goes to the nearest police station. In case of refusal, you should go to court. Of course, there can be a false witness for every witness, and establishing the truth is a rather nervous procedure. But law enforcement officials are skilled enough to spot inconsistencies in testimony. In some cases, it is worth requesting characteristics on yourself about the place of work, study and from the district police officer. This avoids outright slander.
