Step 1

According to its state structure, the Russian Federation, judging by the fact that both the president and the parliament are elected by popular vote, belongs precisely to a mixed republic. But in the Russian Federation, the vote of no confidence does not apply to the terms enshrined in its main law - the Constitution. In the current version, it is interpreted as "Resolution of the State Duma on no confidence in the Government of the Russian Federation."

The possibility of adopting such a resolution is stipulated in Art. 117 of the Constitution of the Russian Federation. According to Art. 141 of the Rules of Procedure of the State Duma, a proposal to express no confidence in the Government may be submitted for consideration by a faction or a deputy group. Its number must be at least 20% of the total number of deputies of this chamber. The regulations stipulate that this proposal must be considered at an extraordinary meeting of the Duma no later than a week after its submission.

Step 3

In order to exclude automatism and bias when considering this issue, a sequence of actions has been determined when discussing the issue of a vote of no confidence in the State Duma. Art. 142 of the Regulation establishes the right of the Chairman of the Government to speak before the deputies and the opportunity to ask the deputies questions to the Prime Minister and members of his cabinet. Representatives of factions and groups of deputies enjoy the preferential right to speak on the resolution of no confidence.

Step 4

The Prime Minister and members of the Government have the right to demand the floor for explanations, but the regulations limit its duration to 3 minutes. The resolution on no confidence in the Government, according to the Rules, is adopted by open vote. According to Art. 143, for this a roll-call vote may be decided. A simple majority of the total number of deputies is enough to make a decision.

Step 5

To dismiss the Government, a decision on no confidence in him must be passed by the Duma twice within three months. In this case, the President has a choice - to dissolve the Cabinet of Ministers, or to dissolve the State Duma. However, if a year has not passed since the election of the Duma, the President has no alternative. All that remains for him is to dissolve the Government.
