There are frequent cases of selling goods without a receipt. As a rule, this is found in markets, in small shops, stalls, in online stores. But if you were sold a low-quality item or it simply did not suit you in color, style, size, you have every right, observing the established deadlines, to return the product or exchange it for a better one, even if there is no receipt.

Instructions

Step 1

You will still have to prove the purchase of goods from a specific seller. Witness testimony, packaging with the seller's logo, serial number of the product, photo or video filming of the purchase process, etc. As a rule, in the markets, when returning products, the seller knows the shortcomings of his goods and, when contacting him on the day of purchase, he readily returns money for a poor-quality product or thing.

Step 2

Contact the seller after presenting the goods. Verbally demand a refund. In case of refusal, make a written claim, listing and attaching all available proof of purchase, registering phone numbers and names of witnesses. State your requirements briefly and to the point. The claim must be written in two copies, one - to the seller, the second remains with you with the following notes: date, signature and stamp of the seller on acceptance of the claim.

Step 3

If the seller refused to accept the claim, contact the administration of the shopping center or market. And send the claim itself by registered mail to the address of the store, the market administration or the seller (if you were told it). Otherwise, apply to Rospotrebnadzor.

Step 4

Insist on seller expertise. By the way, it is advisable to write about this in the claim - let the seller inform you about the date and place of the examination. Checking the quality of the goods should be carried out at the expense of the seller. If the seller categorically refuses to satisfy the claim and does not want to delve into the essence of the requirements, conduct an expert assessment of the quality at your own expense. One way or another, the costs of the examination will ultimately be covered by the seller after the return of the goods (including through the courts).

Step 5

To satisfy your requirements for the return of goods, including without a receipt, the law "On the protection of consumer rights" gives the seller 10 days, counting the day the claim is made (Article 31 of the law), with an examination - 14 days. For each day of delay, you can collect a penalty in the amount of 1% of the value of the goods (Art. 28 of the law).
