Quite often, when making a purchase, the seller does not give the buyer a check, and the buyer does not even try to demand it. And, of course, if a thing is bought on the market, then there can be no question of a check. What to do in a situation when it turns out that the purchased item is of poor quality? It would be quite logical to contact the seller with a request to return the money for the defective item, or exchange it for a better product. This can be done even if you do not have a receipt to confirm the purchase of the product.
Instructions
Step 1
Collect all possible facts proving the purchase of goods from a particular seller. This can be: testimony of witnesses; consumer packaging, which has the appropriate marks of the company, confirming the purchase from this seller; other supporting documents (tag attached to the product, article, product serial number, etc.), as well as any other confirmations.
Step 2
Contact the seller with a request to exchange the product or return the money.
If the seller refuses to comply with your requirements, file a written claim that includes all available evidence of purchase. Be careful when drawing it up, because the outcome of the case depends on the tone in which it is written. It is advisable to write a short and rather harsh claim.
When writing a claim, use the words “I demand” instead of “I ask”. Please write your claim in duplicate. Give one of them to the seller, and keep the other for yourself. Moreover, on your copy of the claim, the seller must make a note that the claim has been accepted and sign or seal. If the seller refuses to accept the claim, immediately contact the administration of the store or market.
Step 3
If the seller begins to accuse you of improper use of the thing purchased from them, insist on an examination, which you have every right to attend. In the claim, be sure to write that you are asking the seller to inform about the time, date and place of the examination; you also have a legal right to this in accordance with the Law "On Protection of Consumer Rights". The examination is carried out at the expense of the seller.
Step 4
If the results of the examination indicate that you have misused, stored or transported the goods, then you reimburse the cost of the examination to the seller.
In the event that the results of the examination will testify in your favor, the seller is obliged to immediately return the money to you for the low-quality product.
Step 5
If the seller cannot immediately satisfy your requirements, he is given 7 days for this, starting from the deadline for the presentation of the demand, and if it becomes necessary to conduct an examination, then 14 days. As you can see, you can only try a little and show perseverance and determination.
