Step 1

Gather a general meeting. You can only part with a non-performing management company by working together. The Housing Code provides for three options for managing multi-apartment residential buildings. It can be an association of homeowners or the board of a cooperative, direct management or a management company, or a housing office. All three methods are absolutely equivalent under Russian law.

Step 2

The procedure for choosing a management method and refusing the services of a management company, if you make such a decision at the end of the year, is approximately the same. The contract with the management company is concluded for no more than 3 years. It can be terminated by the owners unilaterally.

If you find it difficult to bring all apartment owners together, hold an absentee vote. Send out the forms. Fill in the text of the general meeting story. Indicate in it the issue that the owners should consider - for example, the refusal of the services of the management company for such and such reasons. The reasons can be very different. The most popular is the discrepancy between the quality and cost of services. The text should be very short. For the decision to be valid, at least half of the owners must vote for it. Do not forget that the votes are counted in proportion to the square meters owned by this or that owner.

Step 4

Write the minutes of the general meeting. Indicate the number of people who voted. Enter the text of the adopted decision. Pin up the voting forms to the minutes.

Step 5

You can terminate the contract with the housing office in the middle of the year. To do this, also make the decision of the general meeting. Write a collective complaint to the court. In the wording, indicate that you are asking to terminate the contract due to the fact that the utility does not fulfill its obligations. Proof that the contract is being fulfilled must be provided by the utility.

Step 6

Having refused the services of one management company, make sure that the house is not left without maintenance. You can choose another company, enter into direct contracts with suppliers of resources and utilities, create a partnership. If you don't take care of yourself, the municipal government will. In the absence of your decision, she will be obliged to conduct a tender and determine the winner.
