In a social sense, the concept of "self-government" means the concentration of executive power at the very initial levels of the social system. In Russia, the right of citizens to voluntarily organize at their place of residence is guaranteed by the Constitution. Territorial public self-government (TPSG) must be formed and registered in a legal manner.

It is necessary

  • - a copy of the TOS charter;
  • - a copy of the minutes of the constituent assembly;
  • - list of members of the TPSG Council (with indication of passport data);
  • - a list of participants in the constituent assembly;
  • - TOC plan-scheme (with a verbal description);
  • - certificate of the number of adult residents in the area (from the passport office or local administration body);
  • - a receipt for payment of the state duty and its copy.

Instructions

Step 1

Create an initiative group. It must include at least 5-10 active residents of a certain territory - houses, streets, neighborhoods, etc. All members of the initiative group must be adult citizens of the Russian Federation. For consultations at various stages of the creation of self-government, involve specialists - lawyers, economists, public figures.

Step 2

Organize a constituent assembly of citizens for the formation of CBT. The preparation of the meeting will be provided by an initiative group that will closely communicate with both residents and representatives of the local legislative and executive authorities.

Step 3

Check if there is a procedure for creating a TPS approved by the local administration in your city (district, village). If so, act on it. In the case when an officially adopted document does not exist, be guided by the general principles set out in federal law.

Step 4

Define the boundaries of territorial public self-government. At the same time, observe the following requirements: the continuity of the territory, the absence in this territory of already registered TPS or other legal owners of land plots (enterprises, institutions, organizations). The boundaries of the self-government being formed cannot go beyond the city (district). It is necessary to approve the TPS plan-scheme in the local administration.

Step 5

Prepare a draft charter of territorial self-government. In it, be sure to reflect such points as: - the boundaries of the TPSG territory; - the goals, objectives, directions of the TPSG activities; - the procedure for making public decisions, the rights and obligations of the elected self-government bodies, the conditions for the termination of their powers; - the procedure for using the common property of the TPSG, and sources of replenishment of finances and directions of their spending; - conditions and procedure for terminating the activities of territorial self-government of citizens.

Step 6

Bring to the attention of the residents of the territory the details of the upcoming constituent assembly. Post and post in the mailbox notices announcing the date, place and time of the meeting. Indicate the contact numbers and addresses where you can familiarize yourself with the draft charter of the TPSG and additional materials on local self-government issues. Prepare and distribute flyers that answer the most pressing questions concisely and clearly.

Step 7

Develop an agenda for the founding meeting. Include questions on the creation of territorial public self-government within the designated boundaries, on the approval of the TPSG charter, on the election of the TPSG Council, its chairman and other responsible persons.

Step 8

Register all citizens attending the constituent assembly. The decisions of the meeting will be recognized as legitimate if at least half of the adult residents of the territory take part in it. In the registration lists, indicate the last name, first name, patronymic of the citizen, the address of his permanent residence (must be within the boundaries of the TPS) and the date of birth.

Step 9

Draw up the minutes of the constituent assembly. In it, list the issues that were discussed and voted on. Attach the list of those present and the results of the counting of votes for each issue to the minutes.

Step 10

Register TOC with local executive authorities and tax authorities. To the head of the city (district) administration, send a letter notifying about the creation of TPS. The local administration may ask you to provide other documents if this is provided for by the officially approved procedure for organizing self-government in your region.

Step 11

To register a TPSG as a legal entity, the chairman of the local government must submit documents of title to the tax authority. Specify their full list in advance.

Step 12

Pay the state fee before submitting your documents. Check its size in advance with the tax office. Attach the receipt of payment of the state duty and its copy to the package of documents.

Step 13

After checking the documents, the tax authority will put your TPS on state registration as a non-profit organization. You will be issued a certificate of the appropriate model.
