A charitable organization is a non-profit organization created to create public goods in various fields. Depending on the direction of activity, the goals of the association and the number of participants, such organizations may have different organizational and legal forms. However, they all have one thing in common - the desire to help those in need.
Instructions
Step 1
Define the goals that guide you when you start your charity. Despite the fact that such forms of ownership do not pursue commercial goals, some future politicians thus increase their rating among potential voters, since direct support of parties is not charity. But it is possible that by creating such an organization, you really want to help those in need, to which you once belonged yourself. Often, such funds are created in memory of people who have passed away untimely.
Step 2
Choose a line of business for your organization. Depending on the future field of activity, you will have to choose the legal form of your enterprise (foundation, association, association, institution, etc.). In addition, by organizing some of them, you will be able to engage in commercial activities, but only on the condition that all the amounts you receive will go to charitable needs.
Step 3
Develop a charter for your organization based on goals and activities. Hold a meeting of founders and put the charter to a vote. Collect all information about the founders.
Step 4
Contact the tax authorities and, having submitted all the documents, register a legal entity, obtain the Unified State Register of Legal Entities and Rosstat codes, and issue a seal. Please note: Charities are not exempt from all taxes. So they have to pay VAT in full on income received from entrepreneurship, directed to charitable needs. At the same time, income received from other sources is not taxed.
Step 5
Rent a suitable office space. Choose a space in the city center or in an office center building. Charitable foundations' offices located in disadvantaged areas or outside the city do not contribute to the reputation of organizations. Register the name of the organization with Rospatent.
Step 6
Contact the department of the Federal Reserve System under the Ministry of Justice of the Russian Federation to register a charitable organization. You will be asked to submit the following documents: - Application for registration (in 2 copies);
- original and 2 copies of the charter certified by a notary;
- information about the founders (in 2 copies);
- minutes of the constituent assembly (2 certified copies);
- letter of guarantee from the lessor;
- for organizations not lower than the all-Russian level - minutes of conferences, congresses, etc.;
- documents confirming your right to use the name of the organization.
Step 7
Obtain a certificate of registration of your organization in the department of the Federal Reserve System at the Ministry of Justice no later than 30 days later.
