The primary organization is the initial link of the trade union. It is created at the enterprise, institution, organization from among the employees and on their initiative. Trade union members represent and protect the interests of all employees of the enterprise, negotiate with management, take part in resolving labor disputes, etc. The rights, obligations, responsibilities and features of the creation of a primary trade union organization are established by federal legislation.

Step 1

Create an initiative group. It must include at least three employees of your company aged 14 years and older who have Russian citizenship. Members of the initiative group can become both members of the trade union movement and people who are just planning to join a trade union.

Step 2

Do your preparatory work. The initiative group should talk with the majority of the employees of the enterprise, find out their attitude to the idea of creating a primary trade union organization, collect and summarize complaints and suggestions on the organization of labor. Based on the statements of employees, you can draw a conclusion about the need to create a trade union link and the main directions of its activities.

Step 3

Set a date and time for the founding meeting. In order not to aggravate relations with the employer, spend it in neutral territory outside of working hours. Send the invitation to all employees, including managers. When inviting, persuade colleagues, but do not insist on their presence. Participation in a trade union organization is an exclusively voluntary right of everyone.

Step 4

Prepare the meeting agenda and draft articles of incorporation. The agenda should include the following main points: - creation of a primary trade union organization, selection of a branch trade union, registration of a legal entity; - election of the chairman of the primary organization, members of the trade union committee, members of the audit commission; - approval of the Regulation on the primary trade union organization.

Step 5

Have a founding meeting on time. Members of the initiative group, who are the founders of the primary trade union organization, should make reports (messages) on the goals and objectives of the trade union, on the advantages and prospects of the primary organization at the enterprise.

Step 6

Provide an opportunity for meeting attendees to ask all their questions. Be sure to discuss the need to register the primary organization as a legal entity. The law does not categorically require this. Primary organizations that have not formed a legal entity transfer the right to maintain their financial statements to the regional trade union. It is also important to choose a branch trade union, that higher level, which will direct and control the activities of your organization.

Step 7

Familiarize the meeting participants with the main points of the regulation on the primary trade union organization. It must be drawn up in accordance with applicable law. In the regulation, be sure to indicate the goals, objectives, rights of the trade union, its obligations in relation to employees, the procedure for interacting with the employer, the mechanism for joining and leaving the trade union, the amount of membership fees, the regularity of trade union meetings, etc.

Step 8

Take a secret or open vote on each agenda item. Record the results of the meeting in the minutes. In it, indicate the date, time, place of the meeting, the number of participants. List the issues discussed and the results of the vote. Attach a list of all employees present to the minutes.

Step 9

Notify the management of the enterprise about the creation of a primary trade union organization. Register the primary organization with the regional council of trade unions.

Step 10

If a decision is made to register a legal entity, contact the tax office at the location of your enterprise within a month from the date of the creation of the primary trade union organization. Without fail, you must provide originals or notarized copies of the regulation on the primary trade union organization, minutes of the constituent assembly, and a list of trade union members. Check with the state registration authority for a complete list of required documents.
