Instructions

Step 1

People with disabilities and persons representing their interests are everywhere creating public organizations, whose activities are carried out within the territory of the local self-government body. The state provides assistance to such associations, as well as material, technical and financial assistance.

Step 2

Among the main functions of organizations of persons with disabilities is the direct protection of the rights and interests of persons with disabilities. Therefore, initially, a disabled person should complain to the local public association of disabled people.

Step 3

A disabled person can defend their rights in all ways that are not prohibited by law. You can try to solve the problem by contacting directly the state or executive authorities, local self-government. But it is worth remembering that all social services are funded from the budget to carry out their functions. And the provision of social services is carried out at the expense of allocations from the budget. Therefore, the implementation of the right will most likely be postponed until such an opportunity arises for the authority providing this service.

Step 4

In most cases, when creating obstacles to the exercise of rights and freedoms for persons with disabilities, it is better to complain to social bodies for the support and protection of this category of citizens. There they often find support and understanding.

Step 5

If a disabled person informed the employer about his disability and did not refuse to fulfill his individual rehabilitation program, then if the employer violates labor and labor protection legislation in relation to him, the disabled person can complain to the labor inspectorate.

Step 6

If a disabled person believes that he was unlawfully deprived of his disability or reduced the group, he can appeal the decision of the medical and social examination. An application for an appeal against the decision of the ITU or the main bureau is submitted directly to the commission where the examination was carried out or to a higher authority. The application can be submitted in person, sent by mail or electronically through the service portal.

Step 7

Unfortunately, in our country, a specific mechanism to protect the violated rights of disabled people has not been developed or defined. The legislation does not have any special procedure for the protection of the violated right, characteristic only for disabled people. Disputes affecting the rights and freedoms of persons with disabilities are resolved either administratively or in court, and are regulated by the norms of various branches of Russian law.
