A horticultural non-profit partnership can be created by the owners of plots located on the territory for conducting horticultural activities. A feature of these organizations is the fact that the income of the partnership cannot be distributed among its members, but they can be directed to general needs. You can register a garden partnership by preparing and sending documents to the tax office.
Instructions
Step 1
Draw up minutes of the general meeting of garden owners. The document must contain a decision on the creation of a horticultural non-profit partnership, the appointment of its board and chairman. The minutes are signed by all members of the general meeting.
Step 2
Prepare the Charter of the future organization. Write down in it in detail the procedure for organizing a garden partnership, the rights and obligations of its members, the conditions for obtaining membership. List the governing bodies (chairman of the board, board, general meeting), the procedure for their appointment and competence. Describe at the expense of what funds (contributions of members of the partnership) the fund of the organization will be formed, for what purposes it can be used, indicate the procedure for monitoring its spending. The Charter should also contain a clause on actions in case of reorganization and liquidation of the organization.
Step 3
Pay the state duty at any branch of Sberbank for the creation of a legal entity. Apply with the prepared documents (minutes of the general meeting, the Charter of a gardening partnership, a receipt for payment of state duty) to the tax office. Fill out the application for registration of the partnership. The decision on registration is made by the tax department within seven working days. After receiving the state certificate of registration of a legal entity, order the seal of the organization, open a bank account.
