Instructions
Step 1
According to the current legislation, in particular, Federal Law No. 76-FZ of May 27, 1998 "On the Status of Servicemen", this category of citizens exercises their constitutional right to work through military service. The time spent in the ranks of the Russian Army, indicated in the military card, is counted in the total length of service and is taken into account when calculating the continuous length of service, which you need to know to calculate benefits for temporary disability.
Step 2
The length of service of a former soldier will be considered continuous if, after serving in the army, he got a job no later than 1 year after the date indicated on the military card as the end of service. It is important that service in the army is correctly reflected in the work book - the main document according to which the work and continuous length of service is considered.
Step 3
If a citizen first gets a job only after serving in the army, his work book must be drawn up by the employer no later than a week from the date of employment. It must include entries on the terms of military service and list the documents on the basis of which these entries were made.
Step 4
If a citizen returns to the place of work that he left when leaving to serve in the army, then in accordance with paragraph 21a of the Decree of the Government of the Russian Federation of 04.16.2003 No. 225 "On work books", an entry in the work book must be made by an employee of the department personnel of this enterprise. The entry is made on the basis of a military ID or other similar documents: a certificate from the command of a military unit on demobilization or, for higher command personnel, an officer's identity card.
Step 5
Service in the army under the contract is taken into account in the total length of service, as well as in the length of service in the civil service and work in the specialty. In this case, one day in military service is equivalent to one day of work. If a citizen served in the army by conscription, including in accordance with the Decree of the President of the Russian Federation, then one day of service is equivalent to two days at work.
Step 6
Citizens who served in military positions associated with increased danger to health and risk to life, this time is counted in the special length of service. It is taken into account when establishing an old-age pension or a seniority pension, as the length of service associated with special working conditions. The only condition in this case will be that the military position indicated in the military card should be included in the corresponding list approved by the Government of the Russian Federation.
