The law does not regulate any special reasons for the return of a premarital surname. This can be done both in the event of a divorce, and as a result of the death of a spouse, or just like that, if after the marriage the husband's surname suddenly ceased to please.
Instructions
Step 1
In order to return your maiden name, you need to contact the registry office, where the marriage certificate was issued. Usually it is issued at the branch at the place of registration of one of the spouses.
Step 2
The following documents must be taken with you to the registry office:
- own birth certificate;
- certificate of divorce or death certificate of a spouse;
- birth certificates of minor children.
Step 3
An employee of the registry office will ask you to write a statement in which you will need to indicate:
- own surname, first name, patronymic, registration address, date and place of birth, marital status and citizenship;
- Full name and date of birth of all minor children;
- numbers and series of all marriage or divorce certificates issued earlier;
- numbers and series of birth certificates of minor children;
- the surname with which you want to return;
- the reasons for the change of surname.
Step 4
Your application will be considered by the staff of the registry office within a month. However, if you applied for a change of surname not to the registry office where you were issued a marriage certificate, but to any other, then this period is increased to three months. This is due to the fact that at first the employees of the department send requests to the registry office, where the marriage was registered. And only after the response to the request, the consideration of the application begins.
Step 5
When the due date is over, you will be given a certificate of surname change. The birth certificates of underage children will also include data on the mother's new surname.
Step 6
Having received a certificate of surname change, you first need to apply to the passport office to make a new civil passport.
Step 7
Then you need to change all the documents you have on hand: TIN, pension insurance certificate, medical policy, driver's license, foreign passport, and so on.
