Life without conflicts, controversial situations, violations of human rights and freedoms is unlikely. Some citizens decide their issues only in court. Others do not burden themselves with ultra-lengthy proceedings and complex procedures for protecting personal interests. They write pre-trial complaints to various authorities. The main thing is to state your claims intelligibly, reasonably, competently, by contacting government or local authorities. The complaint has its own logic.
Instructions
Step 1
Let's consider complaints about illegal actions of officials. They can be drawn up and sent: to a higher authority, to a supervisory authority, to a court. According to our Constitution, the only source of power in the state is the people. This means that each of us has a certain amount of power that can be used to our advantage. This little power of ours is primary before the "higher" one, and we have the right to defend any of our violated rights and freedoms.
Step 2
People write legitimate complaints so that connivance does not become arbitrariness, and the solution of this or that problem costs the least loss of time, effort and money. It is irrational at the slightest violation of rights to hastily write a statement of claim to the court. Remember: the law grants a citizen the right to appeal against illegal actions of any official by filing a complaint with his immediate superior.
Step 3
You can count on a positive decision on your appeal until the decision is made by the highest body or official of this structure.
A complaint against the action of a representative of a government body is written to the name of his immediate superior, since a document sent immediately to a senior official will again be sent to the manager in whose subordination the complained is.
Step 4
The complaint (this word is mandatory in the table of contents of the document - you cannot write, correctly: “application”, “appeal”) is drawn up in this order. First specify:
a) to which body and to which official the complaint is sent;
b) from whom it is sent: surname, name, patronymic, residence address, place of work.
Step 5
State all the information you know about a person whose actions (inaction) were illegal from your point of view (full name, position, rank, place of work, ID number, etc.). Indicate all the circumstances of the violation of your rights.
Make references to factual data (documents), other evidence of the circumstances that you describe.
Step 6
Attach to the complaint copies of those documents that are relevant to the case (including, if necessary, notarized copies). Please list the attached documents at the end of your complaint. Date and sign.
Step 7
Make a copy of the complaint (its final version) so that you can continue the complaint process if necessary.
