Step 1

Give an order to conduct an auction and create a tender committee. Please note that the commission must be created even before the auction announcement is posted. The commission must include at least 5 people. It is desirable that they have special professional training and experience in participating in tenders for placing orders for state or municipal needs.

Step 2

Develop a notice, tender documentation and determine the initial contract price. The announcement that you plan to give must contain brief characteristics of the purchased goods, works and services.

Step 3

Submit a publication about an open auction and tender documentation for it. This must be done in official publications and on the website https://zakupki.gov.ru. Please note that you can make changes to the tender documentation no later than twenty days before the deadline for submission of applications, but all changes must be published in the printed edition. It is allowed to refuse to hold an open tender 15 days before the deadline for accepting applications.

Step 4

When accepting applications for participation in the auction, keep the information contained in them confidential. Remember, before the envelopes are opened, the participant can withdraw or change his application.

Step 5

The culmination of the open auction is the opening of the envelopes with bids. This must be done in one day, having recorded all the data in the protocol. At the same time, do not forget: the customer must keep and store an audio recording of the envelope opening procedure for three years. All participants in the competition also have the right to audio and video recording of this process. Late applications, although not considered, are necessarily opened and returned to the applicant on the same day.

Step 6

After reviewing all bids for the auction, check them for the accuracy of the specified information. For this, the legislation sets aside 10 days. Once the bids have been matched, determine the winner and publish the evaluation and matching protocol.

Step 7

Then hand over to the winner the draft contract and one copy of the protocol. This must be done within 3 days. If the winner of the tender refuses to conclude a contract, you have the right to force him to fulfill the contract through the courts. Or, alternatively, sign an agreement with the next best bidder. At the same time, price adjustment is possible, but not more than by five percent and only for works and services.

Step 8

If only one application has been submitted to the auction, the tender is declared invalid. But if this single application meets the requirements and conditions of the tender, and the offered price does not exceed the initial one, the customer is obliged to conclude a contract with the only participant in the auction.
