Step 1
Alimony obligations of family members are enshrined in the Family Code of the Russian Federation. The legislator provides an exhaustive list of persons entitled to claim alimony. The most common alimony obligation is the payment of financial support to minor children. If a parent refuses to provide material assistance, voluntarily collection can be enforced on the basis of a court decision based on the material and family situation of the parties.
Step 2
Alimony may be collected not only in favor of the biological parent living with the child, but also paid to the guardian, trustee, or foster parent. Alimony for children in social institutions is credited to the current accounts of these organizations and is accounted for separately for each child. In most cases, child support is paid until the child reaches the age of eighteen. If a child is disabled and needs material support, then the court may establish the payment of alimony in a fixed sum after the child comes of age.
Step 3
The obligations of family members to pay alimony are reciprocal, so adult children are obliged to support and care for their disabled parents. In the absence of voluntary fulfillment of their obligations in favor of needy parents, a decision may be made to pay alimony. The amount of alimony is calculated based on the financial situation of the parties. Parents are paid monthly. Parents deprived of parental rights, as well as parents who did not take proper part in the life and upbringing of the child, cannot claim the payment of alimony.
Step 4
Spouses, as well as former spouses, are obliged to support each other. The basis for receiving alimony is the spouse's disability, the period of the wife's pregnancy and caring for a common child up to three years of age, caring for a disabled child. Former spouses who have been married for an extended period have the right to claim alimony payments if the incapacity for work occurs within one year after the divorce or the spouse has reached retirement age no later than 5 years from the date of divorce.
Step 5
Working-age adult brothers and sisters are obliged to provide material support to their minor brothers and sisters, if financial assistance cannot be provided by the parents of the children. Grandchildren, grandparents are obliged to take care of each other, including financially, provided that the parties have the opportunity to do so and there are no other family members capable of paying financial support. The obligation to pay alimony can be imposed on adult children in relation to the actual caregivers, stepfather and stepmother.
