In the current legislation of the Russian Federation, there are bills concerning maternity payments for the unemployed. But there are also some conditions under which these payments are illegal for this category of citizens.
Will they pay or not
Many women become mothers, working without official registration under the Labor Code or having the status of a housewife. Of course, officially such a woman will be considered unemployed. And many women, being in a position, begin to wonder whether unemployed mothers are paid maternity payments and whether they can count on any benefits.
It is necessary to clearly understand that maternity is paid by the employer, not by the state. With state organizations, everything is very clear - here the employee is immediately issued according to the Labor Code. But with private firms, things are a little more complicated. Many commercial organizations do not formally formalize their employees, so if a woman worked without an employment contract, she cannot count on any maternity payments. If a woman is not officially employed - in the decree she is entitled only to benefits received from the state. The amount of such benefits is not large, and cannot be compared with maternity benefits for working mothers. Sometimes many women rely on the employment exchange - they are registered as unemployed there, hoping for some payments, but after all, they will not pay maternity benefits and unemployment benefits there - they have no right.
Who is supposed to
Not all unemployed citizens on maternity or parental leave are legally entitled to receive benefits. The exception is those cases when the fact of dismissal occurred as a result of the liquidation of the enterprise, and, accordingly, a pregnant woman was laid off. Registration for the accrual of maternity allowance in this case is carried out in the social protection authorities at the place of registration, for this you must provide a full package of required documents. Also, an exception is the case if a woman in labor is undergoing training at the full-time department of an educational institution. For students, the amount of the maternity payment depends on the amount of the scholarship. You can issue such a payment at the place of study.
Unemployed maternity workers are not entitled to a one-time registration allowance early in pregnancy. But some regions carry out the payment of this benefit, despite the provisions of the federal legislation on payments. For example, similar payments for non-working maternity workers are made in the Moscow region. Maternity benefits for the unemployed are paid by the Social Insurance Fund. The amount of maternity benefits for the unemployed category of citizens is calculated based on the amount of unemployment benefits.
