Normative legal acts, which have the force of laws and are, in essence, legislative decisions of the authorities, can be applied in practice only after they come into legal force. The procedure for joining is determined by the current legislation. Citizens' rights, enshrined in the Constitution, imply the official publication of decisions of the authorities for general familiarization in those publications that have the status of official.
Publication is a prerequisite for entry into force
Any normative acts and laws, the content of which relates to the rights, freedoms and obligations of citizens of the Russian Federation, in accordance with Part 3 of Article 15 of the Constitution of the Russian Federation, must be published in the media for general information. Those normative legal acts that, although they were adopted by the relevant authorities, were not promulgated, in practice cannot be applied and are not considered to have come into force. The date of official publication of the regulatory legal decisions of the authorities is used to determine whether the legal norms established by them were in force at the time of the violation or the emergence of legally controversial relations.
Any mass media has the right to publish the decisions of the authorities, but the initial publication is carried out only in those of them that have the status of official ones. They are publicly available and freely distributed to the public with an unlimited subscription. The text of the normative legal act in such publications must be printed in full, without cuts and abbreviations.
Publications that have the status of official
On the basis of Federal Law No. 5-FZ of June 14, 1994 with subsequent additions, the following publications are classified as official publications: “Rossiyskaya Gazeta”, “Parlamentskaya Gazeta”, “Collected Legislation of the Russian Federation”. In addition, since 2011, the official publication is the site www.pravo.gov.ru - "The official Internet portal of legal information."
In accordance with this law, all federal laws, including constitutional ones, as well as regulations - the result of the lawmaking of the Federal Assembly, come into force 10 days after they were published in one of the above official publications. This rule applies in the event that the documents themselves do not stipulate a different order of entry into force. Their action begins simultaneously throughout the country.
When determining the moment of commencement of a particular regulatory legal document, it should be borne in mind that they all have different terms of entry into force after they have been officially promulgated. Thus, acts of tax legislation and legislation on fees have the force of law 1 month after official publication, and presidential decrees of a normative nature - after 7 days, as well as acts of the Government of the Russian Federation affecting constitutional rights and freedoms of citizens or establishing legal status federal executive bodies.
