The trade union (trade union) of workers is a public organization that is created on a voluntary basis and on the basis of common interests related to the type of professional activity.
The organization of a trade union, as a public organization, in principle may not register. However, in this case, it will not have the right of a legal entity, in other words, it will not be able to open bank accounts, accept non-cash transfers of contributions and acquire property on its own behalf. There are no longer any legal restrictions.
Instructions
Step 1
Nevertheless, in practice it turns out that a trade union's lack of registration is often a reason to ignore its influence in various situations: both from the perspective of the employer and in court. But you should know that by law a trade union can represent the interests of its members anywhere, regardless of whether it is a legal entity or not.
If you do decide to register a trade union, first contact the Federal Registration Service (FRS) to verify the documents.
Step 2
After checking with the FRS, register the organization with the tax authorities. To do this, prepare the following information and documents:
- a statement signed by the founder of the trade union and indicating all his passport and contact details;
- printed in three copies the charter of the trade union;
- information about all founders of the trade union;
- data on the location of the permanent operating governing body of the organization;
- documents confirming the payment of the state fee;
- for all-Russian, interregional or international trade unions: minutes of general meetings or constituent congresses of structural divisions;
- if the name of the trade union organization contains a proper name, symbols protected by the laws of the Russian Federation, the full name of another legal entity, etc. - documents that confirm the right to use similar elements in the title.
Step 3
As soon as you receive a certificate confirming the state registration of the trade union, you can open a bank account. If you have done this, be sure to report it to the tax office within 5 days. Otherwise, you will be fined.
